LPAC accepts Fitness Passport for full use of the Gym, Group Exercise Classes and Pool entry.  Fitness Passport cannot be used for squad training and special fitness programs.

Eligibility for concession and discounts

**Seniors concession: a senior concession for entry is available to holders of Seniors Cards issued by the NSW Government and for Commonwealth Seniors Health Cards. Please note Senior Savers Cards are not eligible for seniors concession prices.

**General concession: the general concession for pool entry is available to holders of Pensioner Concession Cards, Health Care Cards and to the children of holders of Pensioner Concession Cards and Health Care Cards (when accompanied by the card holder). 

**Full time student concession: a full time student concession is available on presentation of a valid full time student card issued by an Australian Tertiary Institution. Student concessions are not available for Adult/stroke correction classes.

This document outlines the rights and responsibilities that you have regarding entering a Membership with Inner West Council Aquatics (IWCA).

The facility refers to all Inner West Council Aquatic (IWCA) Facilities its Employees, Agents and Associated Entities. Definitions - In these Terms and Conditions, the following definitions apply: “IWCA”, “We”, “Us”, “Our” means the organisation providing the service for which the Customer is paying. The “Customer”, “Client”, “You”, “Yours” means the person or party signing this Contract. “PT” means Personal Training.

Membership terms and conditions

1. Membership features

1.1 Membership cards must be presented / scanned at reception prior to entry into the centre. Entry will not be permitted without a current membership. Lost cards must be reported to reception for replacement. A fee will be charged for replacement cards.
1.2 Memberships are non-transferable.
1.3 Members have access to the facility and programs during operating hours which may vary from time to time. Facility hours, timetables or other notices are advertised as required.
1.4 Minimum age to purchase a membership is 18 years.
1.5 Gym memberships may be purchased for children aged 14 and over and must be co-signed by a parent or guardian.
1.5.1 Children aged 14 and 15 cannot use the gym families without a supervising adult (18 and over) present.
1.6 Swim memberships for children under the age of 18 must be co-signed by a parent or guardian.
1.7 Membership types and categories can change from time to time as per IWCA fees and charges.
1.8 All members are required to have a photo taken for identity purposes.
1.9 The facility reserves the right to sight concession cards on demand.
1.10 The facility reserves the right to reject an application for membership to the centre.
1.11 The facility reserves the right to alter rules and regulations at its sole discretion.

2. Cancellation/Change of membership

2.1 Memberships are non-refundable. Cancellation of membership and subsequent refund will only be considered due to serious illness or permanent injury, with an accompanying medical certificate.
2.2 Direct debit payment option may be cancelled with at least fourteen (14) days written notice from the member prior to the cancellation date (minimum 2 months membership period must elapse before notice period). Suspensions cannot be used during this fourteen (14) day notice period. If not received, subsequent direct debits will continue until notice is received.
2.3 Any amounts owed to the facility by the member must be paid prior to the cancellation of the membership agreement.
2.4 All memberships have a 7-day cooling off period. A written cancellation request must be received within 7-days of application being lodged. All services used during this 7-days will be charged at the applicable casual rate.
2.5 An existing member can change to a lower cost membership type (down grade) by giving fourteen (14) days’ notice on their current contract or by paying out the fourteen (14) day notice period.
2.6 Management may at its discretion cancel a membership (see Termination of membership - point 6.0).

3. Fortnightly direct debits

3.1 Direct Debit Memberships are payable on a fortnightly basis through the member’s nominated bank account, Visa card, Master card or American Express.
3.2 Payments are made two weeks in advance. Memberships are required to be paid in advance at the time of the commencement; this pro rata is based on the next scheduled Direct Debit payment. Depending on your bank, payments may take up to 5 business days to be processed.
3.3 Direct debit memberships cannot be partially paid upfront.
3.4 Council sets its fees and charges annually; direct debit fees will increase accordingly on or after 1 July each financial year.
3.5 Members must notify the facility of any changes to their bank account details.
3.6 Any failed direct debit payments will incur a failed payment fee.
3.7 Any outstanding payments from a failed direct debit must be paid before access to the facility is granted.
3.8 All bank fees and associated charges are the responsibility of the member.

4. Limited liability

4.1 Members are solely responsible for their decision to participate in exercise and the level of intensity of the chosen activity. It is the members' responsibility to notify their doctor of any changes in their physical condition which may be impact their capacity to exercise.
4.2 The facility, its agents and employees will not be held responsible for any loss, damage or theft of property belonging to the member occurring on the centre’s premises.
4.3 The facility will not be held responsible for any personal injury, illness or death resulting from the use of the facility and / or equipment provided in the centre, except to the extent that such occurred because of negligence on the part of the facility.

5. Membership suspension

5.1 Membership can be suspended. The period of suspension allowed is dependent on the type of membership.
5.2 12-month memberships and direct debit memberships can be suspended for 4 weeks per year.
5.3 6-month memberships can be suspended for 2 weeks per year.
5.4 1-month memberships are not eligible for any suspension period.
5.5 Requests for membership suspension must be submitted via email/online.
5.6 Suspensions may be taken at any time throughout the membership.
5.7 Suspensions must be seven days minimum.
5.8 Application for suspensions must be lodged at least 2 weeks in advance to allow for processing.
5.9 Backdated requests for suspension will not be approved.
5.10 Suspension allowance does not accrue if not used.

6. Termination of membership

6.1 Management reserves the right to terminate any membership if the member is not adhering to all terms and conditions which may include the following:
6.2 The conduct of the member is detrimental to the centre, disruptive, harassing, threatening, abusive, rude or in any way ‘antisocial’ intimidating to other users or to facility staff.
6.3 The member has breached the facility rules and regulations, or any condition, rule or regulation of the facility as posted within the centre.
6.4 The member has defaulted on payments due.
6.5 The member does not follow the instructions of the facility staff.
6.6 Termination of the membership of the member may be done with immediate effect and without notice.
6.7 A member whose membership has been terminated will forfeit all the entitlements of membership with immediate effect and without claim for refund of any fees paid.
6.8 A cancellation fee equivalent to 2 months fees will apply. Any outstanding amounts owed to the facility by the member must be paid within seven days of termination and / or expulsion.
6.9 All decisions made by management under this clause are final and binding.

7. Health and physical condition of member

7.1 By signing this agreement, the member warrants that they are physically capable of participating in exercise.
7.2 The member acknowledges that by maintaining a membership with the Inner West Council Aquatics Facilities, they warrant that they are physically capable of participating in exercise.

8. Availability of IWCA services and facilities

8.1 The facility offers a wide variety of programs and services across a wide range of opening hours and facilities. Classes, instructors, lane availability and access to various programs and services may change from time to time at the discretion of management. No time hold, or credit is applicable because of the above.

9. Change of terms and conditions/rules and regulations

9.1 The facility may add to, change, or remove membership terms, conditions, rules and regulations, including but not limited to the services and facilities offered by the facility from time to time. Any such change will be made available through the website or upon request.

10. Privacy

10.1 IWCA acknowledges and respects the privacy of individuals. The information that is being collected on this document is for the purpose of processing your Membership contract. The intended recipients of this information are IWCA and its authorised staff.
10.2 You will receive communications from IWCA from time to time updating you on items relating to your Membership, or promotions. IWCA uses a range of mediums to communicate with members including, but not restricted to, direct mail, email, SMS and telephone. If you do not wish to have your information that is contained in this document used for this purpose, please advise us; You have the right to access and alter personal information, protecting yourself in accordance with the Commonwealth Privacy Act (Amended 2001).

Personal Training Terms and Conditions

11. Entitlements

11.1 As a PT customer you are entitled instruction with a qualified PT for the duration of time and number of sessions stated. It is strongly recommended that all PT clients become Centre members as your trainer will recommend that you perform exercise sessions in addition to your PT sessions that will require use of specialised equipment.

12. PT Pack Features

12.1 PT packs can only be used at the Centre purchased, unless otherwise specified.

13. Expiry of sessions

13.1 All pre-paid PT sessions must be used within a three (3) year period from the date of purchase.

14. Late arrival

14.1 Please make every effort to arrive on time ready to start your session. If you arrive late, the session must still finish on time. Failure to arrive on time will result in forfeiting the time from the session.

15. Cancellation policy

15.1 If you are unable to make a session or need to reschedule your time, please advise your trainer giving at least 24 hours’ notice. If less than 24 hours’ notice is given you will be charged for the session. Consideration is given for extenuating circumstances. If we must alter the time of your training session, we will attempt to give you at least 24 hours’ notice.

16. Refunds

16.1 PT sessions are non-refundable and non-transferrable. Cancellation of sessions and subsequent refund will be considered due to serious illness or permanent injury, with an accompanying medical certificate.

17. Your physical condition

17.1 All new PT clients are required to complete a Pre-Exercise Questionnaire during their first session to establish their current health status prior to participating in an exercise program. Where answers to questions indicate that you may be at risk, we will request that you receive clearance from a medical practitioner prior to starting your PT sessions and engaging in any physical activity that may be detrimental to your health, safety, comfort, or physical condition. IWCA strongly recommend that all persons seek medical advice prior to starting an exercise program.

18. Changes to your physical condition

18.1 It is your responsibility to advise us of any changes to your health status that may alter your ability to perform your prescribed exercise program.
18.2 You should cancel your PT session giving at least 24 hours’ notice if suffering from any infections, virus, or contagious illness or disease.
18.3 We reserve the right to cancel or discontinue a session if we feel that starting or continuing the session may be detrimental to your health, safety, comfort, or physical condition.

19. Release and indemnity

19.1 In consideration of IWCA accepting you as a PT customer, you agree that IWCA shall not be liable for any loss, damage or theft of any property belonging to, or brought onto the premises by you occurring on said premises except where caused by gross negligence of IWCA.
19.2 IWCA shall not be liable for any death, personal injury or illness occurring upon the premises or as a result of advice or instruction given by trainers and the use of facilities and / or equipment provided by IWCA, except to the extent that such death, personal injury or illness arises from the gross negligence of IWCA.

20. Change of terms and conditions / rules and regulations

20.1 The facility may add to, change, or remove membership terms, conditions, rules and regulations, including but not limited to the services and facilities offered by the facility from time to time. Any such change will be made available through the website or upon request.

21. Privacy

21.1 IWCA acknowledges and respects the privacy of individuals. The information that is being collected on this document is for the purpose of processing your PT contract. The intended recipients of this information are IWCA and its authorised staff.
21.2 You will receive communications from IWCA from time to time updating you on items relating to PT programs, our memberships, or promotions. If you do not wish to have your information that is contained in this document used for this purpose please advise us; You have the right to access and alter personal information, protecting yourself in accordance with the Commonwealth Privacy Act (Amended 2001).

Visit Pass Terms and Conditions

22. Visit Pass Features

22.1 Visit passes must be presented to reception or scanned at the appropriate access gate prior to entry into the centre. Entry will not be permitted without the visit card. Lost cards must be reported to reception for replacement. A fee will be charged for replacement cards.
22.2 Visit passes can only be used at the Centre purchased, unless otherwise specified.
22.3 At the time of purchase of a family visit pass, the names of the nominated members who may redeem these visits must be provided. Only the nominated members can redeem a visit using this pass.
22.4 Members have access to the facility and programs during operating hours which may vary from time to time. Facility hours, timetables or other notices are advertised as required.
22.5 All terms and conditions for visit pass memberships will be as per IWC fees and charges or displayed at the facility.
22.6 All visit pass members are required to have a photo taken for identity purposes.
22.7 The facility reserves the right to sight concession cards on demand.
22.8 The facility reserves the right to alter rules and regulations at its sole discretion.

23. Cancellation/Change of Membership

23.1 Visit passes are non-transferable and non-refundable.
23.2 Visit passes expire three (3) years from the date of purchase and cannot be extended.

24. Limited Liability

24.1 Visit pass members are solely responsible for their decision to participate in exercise and the level of intensity of the chosen activity. It is the visit pass members' responsibility to notify their doctor of any changes in their physical condition which may be impact their capacity to exercise.
24.2 The facility, its agents and employees will not be held responsible for any loss, damage or theft of property belonging to the pass holder whilst in the centre.
24.3 The facility will not be held responsible for any personal injury, illness or death resulting from the use of the facility and / or equipment provided in the centre, except to the extent that such occurred because of negligence on the part of the facility.

25. Visit Pass Suspension

25.1 No time extensions or suspensions are available on visit passes.

26. Termination of Visit Pass

26.1 Management reserves the right to terminate any visit pass membership if the conduct of the member is detrimental to the centre, disruptive, harassing, threatening, abusive, rude or intimidating to other users or to facility staff.
26.2 The member has breached the facility rules and regulations, or any condition, rule or regulation of the facility as posted within the centre.
26.3 The member does not follow the instructions of staff.
26.4 Termination of the visit pass will be at the discretion of management.
26.5 A member whose visit pass has been terminated will forfeit any remaining visits without claim for refund.

27. Health and Physical Condition of Member

27.1 By signing this agreement, the member warrants that they are physically capable of participating in exercise.
27.2 The member acknowledges that by maintaining a membership with the Inner West Council Aquatics Facilities, they warrant that they are physically capable of participating in exercise.

28. Change of Terms and Conditions/ Rules and Regulations

28.1 The facility may add to, change, or remove visit pass terms, conditions, rules and regulations, including but not limited to the services and facilities offered by the facility from time to time.

Squads Terms and Conditions

I understand that by participating in squads’ programs I am agreeing to the following terms and conditions.

30. Senior Squads

30.1 Silver, Gold, and Performance squads will run 50 weeks a year with a 2-week break over the Christmas holiday period. You are entitled to an additional 4 weeks of membership suspension which can be taken at any time throughout the year. Suspension forms must be submitted in writing 2 weeks in advance of the requested period of suspension.

31. Payment of Fees and Direct Debit

31.1 Payment is made by fortnightly direct debit.
31.2 Direct debit can be made from a bank account or credit card and will occur fortnightly. Payments are made two weeks in advance. The first class(s) of the enrolment are required to be paid in advance at the time of the enrolment; this pro rata is based on the next Direct Debit payment. If a scheduled payment day falls on a public holiday, we will debit your account on the next business day. Depending on your bank, payments may take up to 5 business days to be processed. Upon accepting the Debit Success Terms and Conditions the member is agreeing to pay the instalment amount at the agreed payment frequency until the swim lesson membership is formally suspended or cancelled. There is a 7-day cooling off period from the time of enrolment for this membership option.
31.3 Swim School will apply fees associated with the activities offered at the centre as part of gazetted fees and charges. Council sets its fees and charges annually; direct debit fees will increase accordingly on or after 1 July each financial year. By accepting the Debit Success terms and conditions the member is agreeing to all Terms and Conditions.
31.4 All information relating to members financial institutions remains confidential, in line with Inner West Council’s privacy policy.
31.5 The member is responsible for:
31.5.1 Ensuring the nominated account is set up to accept Direct Debit before the first scheduled Direct Debit. Please check with the financial institution where the account is held.
31.5.2 Ensuring there is enough money in the nominated account on the Direct Debit due date and up to 5 business days following. Please note there may be a delay in the processing of Direct Debit if there is a public holiday on the scheduled date of Direct Debit.
31.5.3 If the nominated account does not allow a payment, such as where the account does not have enough money in it or you are over your credit limit, Swim School will require you to make a manual payment online or at the Centre on your next visit.
31.6 Two outstanding failed direct debit payments will result in termination of membership.
31.7 All bank fees and associated charges are the responsibility of the member.
31.7.1 Notifying the Inner West Aquatic Centre of a change of bank details or changing them in the online portal.

32. Suspensions

32.1 There is a maximum of 4 weeks suspension per calendar year.
32.2 All suspension requests must be submitted in writing.
32.3 Medical related suspensions are required to be submitted within a week of the missed lesson and must be accompanied by a medical certificate.
32.4 Non-medical related suspensions must be submitted two weeks prior where possible to the absence from lessons.
32.5 Suspensions over four weeks due to long term illness or injury, please contact Swim School.

33. Cancellations

33.1 All cancellation requests must be submitted in writing.
33.2 Fourteen (14) days notice is required to cease enrolment and the direct debit agreement.
33.3 Non-medical credits or refunds will not be granted for missed lessons prior to written notification. Cancellations will not be processed until any outstanding amounts owing are paid in full.
33.4 Withdrawal due to medical reasons will be actioned as soon as written notification is received, along with a copy of a medical certificate. Notification must be provided within a week of the first missed lesson.
33.5 For cancellation of a squad membership that has been paid up front, refunds are made at the discretion of the centre manager and will be considered due to serious illness or permanent injury, with an accompanying medical certificate.

Rules and regulations

The IWCA facility have pride in the presentation and provision of services and facilities to all users. For this reason, the mandatory Rules and Regulations must be adhered to by members and casual users who must maintain a safe, comfortable and enjoyable environment.

Members and casual participants should have respect and consideration for each other while on the facilities premises. Any internal signage displayed around the centre form part of the member and casual user rules and regulations. If a member or casual participant is seen to be in breach of the centre rules and regulations, management reserves the right to expel them from the premises. Management also reserves the right to take further action if deemed appropriate including cancellation of membership.

Dress code

Members and casual participants must be suitably clothed always while on the facility premises. When exercising in studios or in the gymnasium, shirts/singlets and appropriate covered training shoes must be worn for safety and hygiene.
NO BARE CHESTS. NO BARE FEET.

All swimmers must wear bathing suits in the pool for pool hygiene and safety reasons. Clothing other than swimwear can create problems with pool disinfection and filtration systems. Street clothing such as leggings, underwear, t-shirts and jeans should not be worn as they can become heavy when wet and increase the risk of drowning.

Management reserve the right to refuse entry to patrons wearing apparel deemed inappropriate.

Hygiene and cleanliness

To maintain a hygienic environment, members and casual participants must always bring and use a towel while training at the facility. Participants must always wipe down equipment after use. For additional cleaning requirements in place as a result of any special program or special conditions, information will be available to advise members of these processes.

Children

Gym: Children under 14 year of age are not allowed in the gym unless participating in a supervised program.

Children between the ages of 14-16 years must be supervised at all time by a parent or responsible guardian over the age of 16 at all times whilst in the gym.

Children over 14 years but under 16 may do body weight exercises and use cardio equipment. They are not eligible to do weightlifting or participate in weightlifting group exercise classes.

Pool: Children aged 14 years & under must be supervised by a parent or a guardian who is 16 years or older when using the pool.

The behaviour conduct and safety of any child is the sole responsibility of the parent or guardian.

The parent or guardian is liable for any damage caused by the child whilst on the premises.

Management reserves the right to refuse entry to children at its discretion.

Child minding

A child-minding service is available for members and casual participants. There are a limited number of positions available for children’s safety. Members may book a maximum of one week in advance, with a maximum of three bookings per week. Due to the limited number of positions available children must be dropped off and picked up on time. Failure to cancel an appointment may result in future booking rights being forfeited.

Pools

Members and casual participants must observe pool rules as posted at the centre’s entrance and around the centre.

Members and casual participants must shower before swimming in the facility pools.

Food and drink is not permitted in the indoor pool area.

Children aged 14 years & under must be supervised by a parent or a guardian who is 16 years or older when using the pool.

Children under the age of 5 years must be supervised and within ‘arms reach’ of an approved full paying adult always.
Swimmers must adhere to lane direction and restriction when lap swimming.

Lifeguards are an important safety feature but cannot and do not replace the close supervision of children.

Equipment

All equipment must be replaced after use.

If participating in group fitness class, any equipment used must be placed back in its designated storage area prior to leaving the studio.

Time limits

Time limits may be placed on the use of equipment during peak periods. Etiquette requires that all members and casual participants co-operate with each other on all resistance training equipment in the event of more than one person requiring its use.

Group fitness classes

No entry will be permitted into a group fitness class later than 5 minutes after its commencement.

It may be necessary to book for specific classes in which case members and casual participants must adhere to the booking system to participate.

Lockers

Lockers are provided for member and casual users to use at their own risk. While all care is taken to ensure safety of belongings, the facility will not be held liable for any loss, damage or theft of belongings placed in the lockers or brought onto the premises.

Parking

Parking in the car park provided is done so at the users’ own risk. The facility will not be held responsible for any loss, damage or theft of belongings therein. All users must adhere to all signage and speed limits displayed in the car park.

Prohibited

Alcohol, smoking, illegal drugs, weapons and dangerous substances are prohibited on the premises.

Cameras and mobile phones are not permitted to be used within the change rooms. Cameras are not to be used in any other part of the facility without prior permission from the Pool Superintendent.

Damage to property

Any member or casual user who causes damage to equipment or any property of the facility will be held liable for damages. Members and casual users will be held responsible for damage caused by their children.

Operating hours

The operating hours of the facility will be displayed at the centre and on the facility website.

Operating hours for the centre may vary from time to time.

Management may also change the operating times of activities within facility and will endeavour to notify members.

General behaviour

Conduct of users must not be detrimental to the centre or detract from the enjoyment of the centre by other users. Use of offensive language, behaviour that is disruptive, threatening, abusive, rude or intimidating to other users or staff will not be tolerated. Users must follow the instructions of staff always.

The rules and regulations, and the interpretation thereof are subject to change at management’s discretion. All users should ensure that they are familiar with the current rules and regulations applicable at any time.

Management may grant exception to any of the rules and regulations at its discretion. Any exception granted shall not be construed as a waiver of these rights.
