Current local environment plans (LEP)
A local environmental plan (LEP) is a legal document that provides controls and guidelines for development in an area. It determines what can be built, where it can be built, and what activities can occur on land.
LEPs contain both a written instrument and maps. These should be viewed together to provide an understanding of zoning and building controls across the area or for a particular property.
LEPs are supplemented by development control plans (DCPs), which provide more detailed planning controls for the corresponding area.
The following LEPs apply to development within the Inner West Council area:
Ashfield LEP 2013
The current Ashfield LEP 2013 applies to the following suburbs:
- Croydon Park
- Hurlstone Park
- Summer Hill
Leichhardt LEP 2013
The current Leichhardt LEP 2013 applies to the following suburbs:
- Balmain East
- Camperdown (north of Parramatta Road)
Areas subject to other planning instruments
- Leichhardt LEP 2000 still applies to the Balmain Leagues Club site. The Balmain Leagues Club site was deferred from the Leichhardt LEP 2013 by the Department of Planning and Infrastructure until such time as the current project application is finalised.
- Callan Park (Special Provisions) Act 2002 No 139 applies to the Callan Park site (located between Balmain Road, Iron Cove, Manning and Glover Streets).
- Sydney Regional Environmental Plan No. 26 – City West (state environmental planning policy) applies to area of Sydney Ports and Roads and Maritime Services lands in the vicinity of White Bay, Glebe Island, Rozelle Bay and the Railway Marshalling Yards.
Marrickville LEP 2011
The current Marrickville LEP 2011 applies to the following suburbs:
- Camperdown (south of Parramatta Road)
- Dulwich Hill
- St Peters
Amendments to the Marrickville LEP 2011
Amendment No. 1, was the first round of amendments
to the Marrickville LEP 2011, and came into force on 25 October 2013. It
was a 'housekeeping' amendment which included a number of items.
Amendment No. 3, which relates to revised planning
controls for the land known as 74 Edinburgh Road, Marrickville came into
force on 18 July 2014.
Amendment No. 2, a further 'housekeeping' amendment that included a number of items, came into force on 11 November 2015.
Amendment No. 5, which relates to revised planning
controls for the land known as 141-161 New Canterbury Road, Lewisham
came into force on 15 January 2016.
Amendment No. 6, which lists the development type
"Advertisements – signage on bus and taxi rank shelters" in Schedule 2 –
Exempt Development of MLEP 2011, came into force on 1 April 2016.
Amendment No. 7, a housekeeping amendment to address
a number of errors and omissions in the Plan and Maps adopted by the
Plan, came into force on 26 May 2017.
Amendment No. 9, which relates to amendments to the
planning controls relating to limited residential accommodation in the
B7 Business Park zone and in mixed use developments in certain key sites
and masterplan areas, came into force on 2 June 2017.
Amendment No. 8, which relates to amendments to the
planning controls relating to the property known as 85 Margaret Street,
Petersham, came into force on 16 June 2017.
Amendment No. 11, which relates to an amendment to
the Land Use Table for the B7 Business Park zone to delete "shop top
housing" as a use permitted with consent, came into force on 16 June
Amendment No. 12, which relates to the
reclassification of a parcel of land known as 180 Princes Highway, St
Peters, owned by the former Bankstown City Council, from Community Land
to Operational Land, came into force on 14 July 2017.
Amendment No. 13, which relates to the listing of
the premises at 34 Belmore Street, Enmore as a heritage item, came into
force on 11 August 2017.
Amendment No. 14, which relates to the rezoning of
certain land in the Victoria Road Precinct, Marrickville and amendments
to the planning controls relating to that land, was gazetted on 1
Amendment No. 10, which contains a number of
heritage related amendments, including the listing of additional
heritage items and 2 additional heritage conservation areas (HCAs) and
the expansion of 3 existing HCAs, was gazetted on 22 December 2017.
Amendment No. 15, which relates to the changes to the planning controls for the properties 287-309 Trafalgar Street, 16-20 Fisher Street, 3-7 Regent Street and 13-17 Regent Street, Petersham, was gazetted on 27 July 2018.
Amendment No. 16, which relates to the Sydenham Station Creative Hub, broadens the range of permitted uses for the properties 21-71 Marrickville Road and 101-103 Railway Parade, Marrickville (Key Site "L") to include cafes, restaurants and small bars. It was gazetted on 22 February 2019.
