Voluntary planning agreements register

A voluntary planning agreement (VPA) is an agreement entered into by a planning authority (such as Inner West Council) and a developer. Under the agreement, a developer agrees to provide or fund:

  • public amenities and public services
  • affordable housing
  • transport or other infrastructure.

Contributions can be made through:

  • dedication of land
  • monetary contributions
  • construction of infrastructure
  • provision of materials for public benefit and/or use.

VPAs cannot be entered into unless public notice has been given and an explanatory note is made available for inspection for at least 28 days.

The Easement in Gross will not require outgoings to be paid by Council other than any utilities charges. As the Easement in Gross value includes $30,000/annum over 25 years – items include but not limited to any strata levies, cleaning, general R&M, insurance, land tax etc.

f) Prior to the issue of the first Occupation Certificate for the Development – Darling Lane, (privately owned) made available to Council via a right of way easement, in order to provide access for Darling Street properties and to pedestrianize the through site link. (See Public Open Space Plan prepared by Scott Carver at Annexure B).

g) After Completion but before the issue of the first Occupation Certificate for the Development – 25-year lease of 200m2 commercial space to Council for $1/year for 25 years. Gross lease inclusive of outgoings and any strata levies but excluding utilities charges. The Owner will also make a contribution of a maximum of $100,000 for the fit out of this space. h) Town Square space made available for Council to hold events at no charge to Council for a maximum of 4 single day events per calendar month and the maximum of one per calendar week, provided that only 2 single day events are permitted on a Saturday and Sunday (that is, on a weekend) in a calendar month. A management agreement between Inner West Council and the Owner of the Retail Stratum will be prepared in respect of this use, which can be novated with ownership of the Town Square.
