Rozelle Bunnings Proposal to Land & Environment Court April 2019

The applicant has lodged an appeal against the Council's deemed refusal of this application for a Bunnings site (Artazan Property Group Pty Limited v Inner West Council).

Council received 159 written submissions regarding the proposal, which were submitted to the court at the hearing. Over 100 residents attended, and the Court heard from five speakers who had asked to address the Court.

Following the taking of evidence from the public, the Commissioner made a short inspection of the site and its surrounds, following which the parties returned to the Court for the compulsory conciliation.

The discussions that took place then are confidential and are covered by s34 (10A), (10B), (11), and (12) of the Land and Environment Court Act 1979, and Council is unable to share those discussions with its ratepayers.

The Council pressed its contentions as set out in our Statement of Facts and Contentions (SOFAC); and the applicant sought additional time to produce evidence which they believed will assuage the Council's concerns with the proposal.

Council was not satisfied with the evidence produced, namely with regards to stormwater management and traffic, parking and congestion issues. Unfortunately details of discussions held during Conciliation hearing are confidential.

Update - 10 October 2018

On Wednesday 10 October the Land and Environment Court s34 conciliation hearing for the "Bunnings proposal" for 2 to 8A Parsons Street, Rozelle was terminated.

The matter will now proceed to the Land and Environment Court, with a hearing date set for 16, 17 and 18 April 2019.

Land and Environment Court provisions generally allow only six members of the public to address the hearing.
