Latest on Rozelle Bunnings

The development application to construct a new Bunnings Warehouse at 2-8 and 8A Parsons Street, Rozelle has been appealed to the Land and Environment Court of NSW.

A previous application was refused by Council on grounds including streetscape, heritage, engineering, traffic generation and operational issues. While the current application is yet to be determined by Council, the appeal means the Court is the consent authority and Council intends to defend the appeal. Council's first task will be to prepare a Statement of Facts and Contentions which will set out the reasons why Council believes the Court should refuse the application.

The matter is firstly required to undergo a compulsory conciliation process (under Section 34 of the Land and Environment Court Act 1979) in which Council must participate in good faith. This means Council must make genuine attempts to arrive at a conciliated outcome.

A Section 34 conciliation conference on the matter has been listed for 13 September 2018. All persons who made a submission on the development application will be notified in due course of the conciliation conference and the role they can play therein.
