Planning certificates (Section 10.7)

In accordance with changes to the NSW Environmental Planning and Assessment Act, Section 149 Planning Certificates are now known as Section 10.7 Planning Certificates.

Section 10.7 Planning Certificates, also known as zoning certificates, are legal documents issued by Council under the provisions of Section 10.7 of the Environmental Planning and Assessment Act 1979. The certificate provides information on how a property within the Council area may be used, what planning instruments apply; as well as property affectations/restrictions on development. While the certificate will state all the relevant planning instruments that apply to the property, it does not identify the specific development standards or terms of the instruments.

A Section 10.7 Planning Certificate is required upon the sale and purchase of a property. A Section 10.7 Planning Certificate application is required to be lodged per allotment on a property.   

Types of Section 10.7 Planning Certificates

Section 10.7 (2) Planning Certificate

Section 10.7 (2) Planning Certificate provides planning information such as zoning, the relevant state, regional and local planning controls and other planning affectations including complying development.

Section 10.7 (2) and (5) Planning Certificate

Section 10.7 (2) and (5) Planning Certificate includes information available in Section 10.7 (2) Planning Certificates and additional information affecting the land where Council has information available.

Processing times

A Section 10.7 Planning Certificate is processed generally within 5 working days. For urgent applications a Section 10.7 Planning Certificate is processed within a maximum of 2 working days.
