Leichhardt DCP

New employment zones came into effect on 26 April 2023 in NSW. For more details on these reforms visit the Department of Planning and Environment website.

Any reference to a former zone in a development control plan and/or other planning documents is legally taken to be a reference to these new employment zones.

The Leichhardt Development Control Plan (DCP) 2013 came into force on Monday 3 February 2014, the same day as the gazettal of the Leichhardt Local Environmental Plan (LEP) 2013.

This DCP supplements and supports the Inner West Local Environmental Plan (LEP) 2022. It outlines planning and design guidelines for particular types of development that require Council approval.

The DCP consists of the following sections and chapters:

The Leichhardt DCP 2013 replaced all of the 12 former Leichhardt DCPs, except in relation to the Balmain Leagues Club site (see Amendment 4 below). The Leichhardt DCP 2000 still applies to this land.

List of amendments

The current version of the Leichhardt DCP 2013 incorporates the following amendments:

Amendment 1: 22 and 30-40 George Street, Leichhardt (Kolotex and Labelcraft)

This site-specific DCP was adopted by the Director General of the Department of Planning and Infrastructure in 2014 and came into effect on 11 of March 2014. It provides specific controls for 22 and 30-40 George Street, Leichhardt.

Some sections of the Leichhardt DCP 2013 still apply to this site (see page 5 of the amendment document for the full list) – however, in the event of any inconsistencies, this site specific DCP overrides the Leichhardt DCP 2013.

Amendment 2: Housekeeping (amendment to C3.2)

This amendment corrected some minor spelling and formatting errors in this specific section of the DCP.

Amendment 3: 141 and 159 Allen Street Leichhardt (Amendment to Part G)

Site specific controls for 141 and 159 Allen Street Leichhardt were added to Part G of the DCP. This amendment came into effect on 15 July 2015.

Amendment 4: Balmain Leagues Club site (amendment to Part A)

This DCP amendment, which applied from 22 September 2015, confirmed that the Leichhardt DCP 2000 applies to the Balmain Leagues Club site, which comprises the following properties:

  • 138-152 Victoria Road, Rozelle (Lot 1 DP 528045)
  • 154-156 Victoria Road, Rozelle (Lot 1 DP 109047)
  • 697 Darling Street, Rozelle (Lot 104 DP 733658)
  • 1-7 Waterloo Street, Rozelle (Lots 101 and 102, DP 629133, Lots 37 and 38, DP 421 and Lot 36 DP 190866)
  • 168-172 Victoria Road, Rozelle (Lot 2 DP 323480 and Lots A and B, DP 436153)

Amendment 5: Housekeeping

This amendment corrected some minor spelling, formatting and mapping errors and inaccuracies in relation to terms, definitions, referencing and figures in all sections of the DCP. This amendment came into effect on 19 April 2016.

Amendment 6: Amendment to Part C (Clause C1.14.17)

Specific control to Clause 1.14.7 Criteria for assessment of tree removal was added. This amendment came into effect on 31 May 2016.

Amendment 7: Licensed Premises

The purpose of this amendment was to create development controls for small bars, restaurants and cafes with capacity for 120 persons or less, that are less onerous than those controls applied to larger premises such as pubs, registered clubs and licensed hotels. This amendment came into effect on 20 December 2016.

Amendment 8 - Amendment to Part A (Clause A3.9) (9 May 2017)

Specific amendment to clause A3.9 Activity Applications to simply notification requirements for type of activities covered by Local Approvals Policy.

Amendment 9 – Amendment to Part G (Site Specific Controls for 168 Norton Street, Leichhardt)

Site specific controls for 168 Norton Street, Leichhardt were addedto Part G of the DCP. This amendment came into effect on 27 April 2018.

Amendment 10 – Amendment to Appendix E (Water Guidelines) Section 4 and 5

This amendment involves changes to the Section 4 – Flood Control LotMaps and Section 5 – Foreshore Flood Control Lot Maps of Appendix E:Water Guidelines. This amendment came into effect on 6 July 2018.

Amendment 11 – Amendment to Part G (site specific controls for 17 Marion Street, Leichhardt)

Site specific controls for 17 Marion Street, Leichhardt were added to Part G of the DCP. This amendment came into effect on 21 September 2018.

Amendment 12 – Housekeeping

Housekeeping amendments relating to waste management, flood and stormwater management, car parking controls and administrative and legislative updates. This amendment came into effect on 1 August 2019.

Amendment 13 – Tree Management

Amendments to Part C1.14 – Tree Management to harmonise tree management controls across the Inner West LGA. This amendment came into effect on 20 March 2020.

Amendment 14 - Notification

Amendment to Part A – Introduction – Section 3 – Notification of Applications. Replaced contents of this section with link to Council’s Community Engagement Framework. Amendment to Part C – Section 1 – C1.11 Parking. Clause relating to car share provision was deleted. This amendment came into effect on 3 July 2020.

Amendment 15 – Amendment to Part G (site specific controls for 1-5 Chester Street, Annandale)

Site specific controls for 1-5 Chester Street, Annandale were added to Part G of the DCP. This amendment came into effect on 9 April 2021.

Amendment 16 – Housekeeping

Housekeeping amendment to ensure consistency with Inner West Local Environmental Plan 2022. This amendment came into effect on 9 September 2022.

Amendment 17 – Amendment to Part G (site specific controls for 36 Lonsdale Street and 64-70 Brenan Street, Lilyfield)

Site specific controls for 36 Lonsdale Street and 64-70 Brenan Street, Lilyfield were added to Part G of the DCP. This amendment came into effect on 20 December 2022.

Amendment 18 – Amendment to Part C: Place (C1.14 Tree Management)

Controls for tree management were updated to simplify the process and ensure compliance with relevant legislation . This amendment came into effect on 1 April 2023.

Amendment 19 - Amendment to Part G (site specific controls for 122-130 Pyrmont Bridge Road and 206 Parramatta Road, Annandale)

Site specific controls for 122-130 Pyrmont Bridge Road and 206 Parramatta Road, Annandale were added to Part G Section 13 of the DCP. This amendment came into effect on 2 November 2023.

The Tree Management Technical Manual

The Leichhardt Development Control Plan (DCP) 2013 is supplemented by the Tree Management Technical Manual.

The Tree Management Technical Manual provides information and guidance on the removal and pruning of trees on private properties and indicates when a development application may be necessary

The Leichhardt DCP 2013 replaces the former Leichhardt Tree Preservation Order.
